TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

Sports Met LLC (“Sportsmet”) provides its services subject to the following Terms of Service (“TOS”), which may be updated from time to time without notice. The most current version of the TOS may be reviewed at:

In addition, when using specific Sportsmet services, both you and Sportsmet shall be subject to any posted guidelines or rules applicable to such services, which may be updated from time to time. As commissioner or organizer of any Sportsmet fantasy sports pools, you will be subject to specific pool terms, conditions, and rules. All such conditions, guidelines, and rules are incorporated by reference into these Terms.

These Terms contain important information regarding your rights and obligations, including limitations of liability and an arbitration agreement with a class action waiver.

By using the Service, you agree to resolve disputes through binding individual arbitration and waive the right to participate in class actions.

If you do not agree to these Terms or the Privacy Policy, do not use the Service.

2. DESCRIPTION OF SERVICE

Sportsmet provides pool commissioners with a web‑based and mobile‑based platform for creating, hosting, and managing sports and pop‑culture pools. All pools are private and are run at the sole discretion of the pool commissioner, who controls pool‑specific rules, settings, and scoring.

By joining a private pool, participants acknowledge the commissioner’s control over pool‑specific matters. Notwithstanding the foregoing, Sportsmet retains independent authority to enforce these Terms, including user conduct standards and content moderation.

Sportsmet provides its services to pool commissioners for a fee. There is no charge for pool participants. All fees are final.

3. ENTERTAINMENT PURPOSES ONLY

All Sportsmet services are provided for ENTERTAINMENT AND/OR MARKETING PURPOSES ONLY and may not be used in connection with gambling or wagering.

4. RESERVATION OF RIGHTS

Sportsmet reserves the right to modify, suspend, restrict, or terminate any service or user account if a user violates these Terms or acts inconsistently with their spirit.

Sportsmet may alter or discontinue services at any time without liability. Users may not sell or monetize data obtained through the Service.

5. SERVICE INTERRUPTION

Sportsmet does not guarantee uninterrupted service. Interruptions may occur due to factors beyond our control. Sportsmet is not liable for consequences of service interruptions.

6. YOUR REGISTRATION OBLIGATIONS

Users must provide accurate registration information and keep it current. Users are responsible for all activity under their accounts.

7. PRIVACY POLICY

Sportsmet collects and processes personal data in accordance with its Privacy Policy, available at:

8. USERNAME, PASSWORD, AND SECURITY

Users are responsible for safeguarding account credentials. Sportsmet is not liable for unauthorized account access resulting from user negligence.

9. USER‑GENERATED CONTENT

The Service allows users to create, post, upload, share, and interact with content (“User Content”). Users are solely responsible for their User Content and interactions.

Sportsmet does not endorse User Content but retains full enforcement authority.

10. PROHIBITED CONTENT AND ZERO‑TOLERANCE POLICY

Sportsmet maintains zero tolerance for objectionable content or abusive behavior.

Users may not post or engage in content that is:

Harassing, threatening, abusive, or intimidating
Hateful, discriminatory, or demeaning
Sexually explicit, pornographic, or obscene
Violent or encouraging harm
Fraudulent or misleading
Illegal or infringing on rights
Otherwise objectionable as determined by Sportsmet

Violations may result in immediate content removal and account suspension or termination.

11. CONTENT MODERATION, REPORTING, AND BLOCKING

Sportsmet reserves the right to monitor and moderate User Content.

The Service provides mechanisms to:

Report objectionable content
Block abusive users

When a user blocks another user, the blocked user’s content is immediately removed from the reporting user’s feed, and Sportsmet is notified.

Sportsmet will act on valid reports of objectionable content within 24 hours, including content removal and enforcement action.

12. LOCATION OF LAWSUIT

Except as otherwise provided in the Arbitration section, users consent to jurisdiction in the State of Delaware.

13. INVALIDITY OF SPECIFIC TERMS

If any provision is found invalid, the remaining provisions remain enforceable.

14. LIABILITY LIMIT & DISCLAIMERS

IN NO EVENT SHALL SPORTSMET BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE SIX MONTHS PRIOR TO THE CLAIM OR (B) $50, TO THE EXTENT PERMITTED BY LAW.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

15. AGREEMENT TO ARBITRATE AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY.

Except as stated below, any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by JAMS under its Consumer Arbitration Rules.

This arbitration agreement is governed by the Federal Arbitration Act. Delaware law applies where state law is relevant.

Arbitration may be conducted remotely or, if in person, in Delaware or the user’s state of residence.

Each party bears its own legal fees unless otherwise required by law.

The arbitrator has exclusive authority to resolve disputes relating to enforceability and may award individual relief only.

Class actions and representative proceedings are not permitted. If this waiver is found unenforceable, the arbitration provision is void.

Either party may bring qualifying claims in small claims court or seek temporary injunctive relief.

Users may opt out of arbitration within 60 days of first accepting these Terms by emailing:

If a claim proceeds in court, venue shall lie exclusively in Delaware state or federal courts.

16. INDEMNITY

You agree to indemnify and hold harmless Sportsmet from claims arising out of your use of the Service or violation of these Terms.
